Terms of Use

1. Purpose

These General Terms of Use (hereinafter "GTU") define the conditions and terms of use of the CookUp platform (hereinafter "the Platform") as well as the rights and obligations of the parties within this framework.

Any use of the Platform implies unreserved acceptance of these GTU.

2. Definitions

• Platform: The CookUp website and mobile application
• User: Any person accessing the Platform
• Client: User placing an order via the Platform
• Chef: Professional offering culinary services via the Platform
• Service: All functionalities offered by CookUp

3. Acceptance of GTU

Use of the Platform implies full and unreserved acceptance of these GTU. If you do not accept these conditions, you must not use the Platform.

CookUp reserves the right to modify these GTU at any time. Modifications take effect upon their publication on the Platform. It is recommended to consult the GTU regularly.

4. Access to the Platform

Access to the Platform is free. However, some services may be subject to a fee. The user undertakes to use the Platform in accordance with its purpose and in compliance with applicable laws and regulations.

CookUp reserves the right to suspend or prohibit access to the Platform to any user who does not comply with these GTU.

5. Registration and User Account

To use certain services of the Platform, the user must create an account. The user undertakes to provide accurate, complete and up-to-date information.

The user is responsible for the confidentiality of their login credentials. Any activity carried out with their credentials is presumed to have been carried out by the user.

6. Orders and Payments

Orders placed via the Platform constitute an offer to purchase. Order confirmation constitutes acceptance of the offer by the Chef.

Prices are indicated in euros including VAT. CookUp reserves the right to modify prices at any time, it being understood that the applicable prices are those in force at the time of the order.

Payment is made online securely. Accepted payment methods are indicated during the order process.

7. Delivery

Delivery times are indicated during the order. CookUp strives to respect these deadlines but cannot be held responsible for delays due to circumstances beyond its control.

In case of absence of the recipient, the Chef or the delivery person will try to contact them. If no contact is possible, the order may be canceled according to the conditions provided.

8. Right of Withdrawal

In accordance with current legislation, the Client has a period of 14 days to exercise their right of withdrawal, except for perishable or personalized products.

To exercise this right, the Client must notify their decision to withdraw by email to contact@cookup.com before the deadline.

9. Intellectual Property

The Platform and all its content (texts, images, logos, etc.) are protected by intellectual property rights. Any reproduction, even partial, is prohibited without prior authorization from CookUp.

10. Responsibility

CookUp acts as an intermediary between Clients and Chefs. CookUp's responsibility is limited to connecting them. Responsibility for the quality of dishes and delivery lies with the Chef.

CookUp cannot be held responsible for indirect damages resulting from the use of the Platform.

11. Personal Data

12. Applicable Law and Jurisdiction

These GTU are governed by French law. In case of dispute, and failing amicable agreement, the dispute will be brought before the competent French courts.
